Host terms
You accept these terms when you make a host account, and again whenever we change them, before you can buy or start a pass. They sit alongside the terms of play and the privacy notice. Where these terms and the terms of play differ, these terms apply to you as a host.
1. Who the agreement is with
EGGS DOWN is an ArcSystemsTechnology game, part of the Martin Gabriel Holdings group. The service is provided by ArcGabriel Ltd, a private limited company registered in England and Wales, company number 17389329, Carlile Institute Business Centre, 54 Huddersfield Road, Meltham, Holmfirth HD9 4AE ("we", "us"). "You" means the person who holds the host account, and, for a Commercial pass, the business or organisation that person acts for.
2. What we provide, and what we do not
We provide software: a bingo game that runs in a browser, with cards, calls, a caller and the features of your pass. We do not organise, run, supervise or attend your game. We do not know who is in the room, what they are drinking, where they are, or how they are getting home. You do.
3. You run the game
- Who plays. EGGS DOWN is for adults. You make sure everybody playing in a room you host is 18 or over, and, in a drinking room, old enough to drink alcohol where they are.
- The room. You choose classic, party or drinking, the speed, the powers and the language, and you are responsible for that choice being suitable for the people playing.
- Safety and conduct. You are responsible for the place you play in, the people at your game, how they behave towards each other, and making sure nobody is pressured into anything. Use the swap, remove a player or end the game whenever that is the right thing to do.
- Photos and names. You remove any name or photo that is offensive or used without the person's agreement.
4. Alcohol
A drinking room only ever suggests a sip, always with a swap that involves no alcohol, and a cap per player per round. Whether anyone drinks, what and how much is their own decision, and keeping drinking safe at your game is your responsibility, not ours. Never encourage anyone to drink who does not want to, who has had enough, who is under the legal drinking age, or who is going to drive. Advice: Drinkaware.
5. Commercial passes: venues, events and businesses
- Licensing. You are responsible for complying with the licensing law where you play. In England and Wales, the mandatory licensing conditions forbid irresponsible drinks promotions on licensed premises, including games that require or encourage people to drink; laws elsewhere may be similar. Unless you are sure your use is lawful, run party or classic rooms, which never mention a drink.
- Prizes and entry fees. EGGS DOWN has no stakes or prizes and is not a gambling product. If you charge to take part or offer prizes, you are responsible for complying with gambling law (in Great Britain, the Gambling Act 2005, which controls prize gaming and bingo), and for any licence that needs.
- Showing the game. The pass allows you to show EGGS DOWN, including its caller and its music, which we own, to your customers on your premises and at your events while it lasts. Any other music, broadcast or content you play alongside it needs its own licence.
- Your people. You are responsible for your staff and for the information you give your customers.
6. Your account
Keep your password and recovery code private; anything done with your account is treated as done by you. One account is for one host or one organisation. Do not resell, share or sub-license a pass. Do not try to overload, probe, copy or interfere with the service.
7. Availability
We work to keep EGGS DOWN running, fair and secure, but we provide it as it is and as available. We do not promise that it will be uninterrupted, error-free, available in every country or on every device, or that any particular voice or language will be available on a given phone. We may change or withdraw features, but not in a way that takes away what you have paid for during your pass without a refund for the time left.
8. The limits of our liability
What we never limit. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to exclude or limit. If you are a consumer, nothing in these terms affects your legal rights, including under the Consumer Rights Act 2015 and the mandatory consumer protections of the country where you live.
What happens at your game is not our responsibility. To the fullest extent the law allows, we are not responsible for any loss, injury, illness, damage or claim arising from the conduct of a game you host, including anything anyone drinks, how people behave, the premises, travel, or any breach by you of licensing, gambling or other law, except where it is caused by our own negligence or breach of these terms.
If you are a consumer (an All-Pass used privately): we are responsible only for loss that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, and we do not supply the service for business use, so we are not responsible for any business loss.
If you are a business (a Commercial pass, or any use for business): we are not liable for loss of profit, revenue, business, contracts, goodwill or anticipated savings, for loss or corruption of data, or for any indirect or consequential loss, however it arises; and our total liability to you arising from or in connection with these terms, in contract, tort (including negligence) or otherwise, is limited to the amount you paid us in the twelve months before the event giving rise to the claim. All terms implied by law are excluded to the extent the law allows.
Your responsibility to us (businesses only): you will reimburse us for any claim brought against us by a player, customer, authority or anyone else arising from a game you hosted or your breach of these terms, including reasonable legal costs, except to the extent the claim arises from our own negligence or breach.
9. Ending
You can delete your account at any time from the passes page; a pass ends with the account. We may suspend or close an account that breaks these terms, after telling you why unless the law or someone's safety stops us; if we close it without your breach, we refund the unused part of your pass.
10. Changes
We may update these terms, for example for a change in the law or the game. The version is shown at the top. When it changes, we ask you to accept the new version before you buy or start another pass; a pass you already hold keeps running.
11. The law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland you may also bring proceedings there, and if you are a consumer living elsewhere you keep the protections that the law of your own country gives you and cannot be taken away by agreement.
